These Terms of Use (hereinafter referred to as the “Terms”) and any rules published on the Site, including the Privacy Policy (hereinafter referred to as the “Policy”) and the Offer to enter into a charitable donation agreement (hereinafter referred to as the “Offer”), constitute a complete legally binding agreement between you (the “User”, “You”) and the Charitable Organization “Charitable Foundation “Dzyga’s Paw” EDRPOU: 44831336, location: Lviv, 79005, Ukraine, Lviv region, Svobody ave. 1/3, apartment 19A, represented by Director Dmytro Mykolayovych Zhluktenko, acting on the basis of the Charter, (hereinafter referred to as the “Foundation”), which governs your use of the website https://dzygaspaw.com/ (hereinafter referred to as the “Site”), as well as all text, data, information, etc. (hereinafter collectively referred to as the “Content”) and the collection of charitable donations through the Site.
We reserve the right to make any changes to these Terms. To stay informed of current changes in the operation of the Site, we recommend that you review this page from time to time.
By using the Site, you represent and confirm the following: you have the legal capacity and right to enter into this agreement according to the laws of your country; the laws of your country do not restrict you from using the Site; you comply with these Terms, you understand the content and the relevant legal requirements. If you do not agree with these Terms, please do not use this Site.
1. Activities of the Foundation.
2. Objectives of the Foundation
To fulfill the objectives of the Foundation, as defined by the Statute, the Foundation:
- raises funds and items from benefactors – individuals (residents and non-residents), legal entities, charitable organizations, including international ones;
- organizes the management of the collected funds in order to maintain and increase the amount of funds used for assistance;
- provides assistance and develops and implements programmes aimed at realizing the Foundation’s goals;
- other tasks aimed at the implementation of the Foundation’s mission.
3. Terms and conditions of the charitable donation.
Provision of a charitable donation is regulated by the Offer.
In order to monitor the charitable donations made and to subscribe/cancel regular charitable donations in the form of daily/weekly/monthly payments, the User may create a personal account. A personal account can also be created by the Foundation for the User automatically after the User makes a charitable donation on the Site. The User’s personal data stored in such an account is governed by the Foundation’s Privacy Policy.
Please note! Charitable donation is provided by payment service providers and is governed by their terms of use and privacy policies. The Foundation has no influence on the fees and exchange rates applied by such providers. In no event shall the Foundation be responsible for the payment information provided by you, which is processed by such providers in accordance with their privacy policies. Users can also send humanitarian aid to the Foundation. The list of items the Foundation collects is published on the Website with regular updates. How-to-send-items-instruction can be found here.
4. Reports
The list of received charitable donations is published on the Website in real time. Reports on the use of charitable donations are published on the Site on a weekly basis. The report on equipment purchases, as well as the total amount of donations received and funds spent for each previous month are presented on the Site. An annual report on the use of income (profits) of a non-profit organization in the prescribed form is submitted to the State Tax Service of Ukraine.
5. Website Content
The Content of the Site is owned and controlled by the Foundation. If the materials contained or to be contained on the Site belong to other persons on the basis of copyright, such materials may be published on the Site only with the consent of the author. The Content, or any of its elements, are forbidden to be used without the prior permission of the Foundation or the respective authors.
Subject to the Terms, the Foundation grants you a limited, non-exclusive, revocable license, without the right to sublicense or transfer, to: use the Site from your personal devices under these Terms; and access and view any Content on the Site, solely for your personal, non-commercial use.
You do not obtain any additional rights as a result of downloading or making copies of the Content other than those set forth above. You may not reproduce, publish, transmit, distribute, modify, create derivative works from, or otherwise exploit the Content for any commercial or unlawful purpose without our prior written permission. You agree not to alter or remove any proprietary notices from materials downloaded or printed from the Site.
The Foundation may modify the terms or revoke this license or terminate your access to the Content at any time and for any reason without prior notice.
6. Links to other websites
This Site contains links to third-party websites. We are not responsible for the content, terms of use or privacy policy of such websites. Once you have used these links to leave the Site, any information you provide to these third parties is not subject to either these Terms or the Policy. Before visiting and providing any information to third-party websites, we encourage you to read the provisions governing their use, privacy and protection of visitors’ personal data.
7. Responsibility
The Foundation is responsible for the targeted use of charitable donations in accordance with the current legislation of Ukraine.
8. Limitation of liability
The Foundation shall not be liable for any direct or indirect damages, costs, losses or liabilities incurred as a result of your access, use, inability to use or modify the Content of the Site or any other website links to which you may find on the Site. The Foundation is also not responsible for the support of the material specified on the Site, as well as for making corrections, updates or complete or partial changes. All materials on the Site may be changed without prior notice to Users.
9. Jurisdiction and applicable law
The Foundation in the process of carrying out its activities is guided by the legislation of Ukraine. Any disputes or claims that may arise in connection with or as a result of using the Site will be resolved in accordance with the rules and regulations of applicable law by the courts of Ukraine. Users who visit the Site, being outside Ukraine, additionally agree to comply with the laws of the host country and to be liable within the limits set by the applicable law. The Foundation also reserves the right to restrict the content of the Site to any person or specific geographical area at any time without prior notice to the User.

11. Other
If any provision of these Terms becomes invalid or is deemed invalid, the remaining provisions shall remain in force as before and shall act as if the provision were declared invalid or unenforceable, never contained in these Terms.
These Terms and all related documentation are in Ukrainian, but for the sake of accessibility and understanding of these provisions by all Users, these Terms may be translated into English and into other languages. In case of any discrepancies, the Ukrainian version of the Terms and other documentation will prevail.

By providing us with your e-mail address through the Site, you understand and agree that we may send you messages to the contact information you provided, including notifications of updates to the Site and these Terms; information or materials related to your use of the Site, making charitable donations and their use.
